What your attorney actually does
There is more to a property purchase than signing an agreement. We look at the legal position, explain what it means for you and coordinate the steps needed to complete the transaction.
- 01
Understand the purchase
We discuss the property, your funding, your timeline and any documents already received.
- 02
Check the legal position
We investigate title and relevant restrictions, review the agreement and identify issues that need attention.
- 03
Coordinate the moving parts
We work with the vendor’s attorney and, where relevant, your lender to address requirements and explain your next steps.
- 04
Work towards completion
We guide the legal documentation, completion arrangements and registration steps, keeping you informed as the matter progresses.
A QUESTION WE HEAR OFTEN:
“There is a mortgage on the title.
Am I going to be responsible for it?”
A mortgage on the title needs a proper plan. It does not automatically mean the purchase cannot proceed.
The title records security held over the property. Your attorney needs to establish what is owed and how the existing mortgage will be dealt with as part of the sale.
That may involve repayment from the sale proceeds and arrangements for a discharge. The agreement, lender requirements and registration position all matter. Do not assume the entry will simply disappear when you pay the purchase price.
We explain the issue, the proposed solution and what needs to happen before you move forward.
WHEN IT ISN’T STRAIGHTFORWARD
A problem needs a route forward. Finding a problem doesn't necessarily mean the purchase cannot proceed. It means the problem needs to be properly understood and a safe route forward identified.
Mortgage on title
What must be repaid, discharged or otherwise addressed?
Caveat
Who is claiming an interest, and how does it affect registration?
Subdivision / splinter title
Is the separate title available, and what remains outstanding?
Estate property
Does the person selling have the legal authority to do so?
Survey or description issue
Do the boundaries and documents describe the property you intend to buy?
Other title problems
What restrictions, missing documents or competing interests need attention?
“Understand the issue. Identify the next step. Make an informed decision.”
FUNDING YOUR PURCHASE
Buying with a mortgage
Your purchase and your loan need to work together. A lender’s approval is one part of the process; its documentation, conditions and release of funds also need attention.
We help you understand the legal requirements and coordinate with the other parties so you know what is still needed.
You, the purchaser
Provide documents, arrange funding and make informed decisions.
Your attorney
Advise on the purchase and coordinate the legal steps.
The vendor’s attorney
Handle the vendor’s side and relevant completion requirements.
Your lender
