NON-CONTENTIOUS DIVORCE IN JAMAICA
“I don’t want a fight. I just want to get divorced and move on.” If your marriage is over, you need clear advice about the legal steps ahead. KSA’s non-contentious divorce service is for matters where the divorce is not expected to be contested and there is no potential dispute over custody or maintenance.

START WITH THE RIGHT FIT
A divorce can be legally possible
without fitting this service.
Jamaica is a no-fault jurisdiction. The ground for divorce is the irretrievable breakdown of the marriage. Both spouses’ consent is not required to file.
KSA still needs to understand whether the matter is suitable for our non-contentious service.
This service may fit where…
- You meet the requirements to bring proceedings in Jamaica.
- The divorce is not expected to be contested.
- There is no potential dispute over custody or maintenance.
- Any necessary arrangements for children can be properly explained to the court.
Tell us before proceeding if…
- Your spouse may contest the divorce.
- There is a potential custody dispute.
- Maintenance is, or may become, disputed.
- You are unsure about any of these issues.
Potential disputes take the matter outside KSA’s non-contentious scope. We need to assess the position before accepting the matter.
What we need to understand about your marriage and separation.
THE ORDINARY STARTING REQUIREMENTS
2 years
Length of marriage. The ordinary filing position is that you have been married for at least two years. If you have been married for less, tell us so we can advise on your circumstances.
12 months
Living separate and apart. At least 12 months of separation. Living in the same house may qualify where you maintain separate households and have stopped acting as a couple. The facts need to be explained.
Your history
Steps towards reconciliation. Tell us what steps you took to try to save the marriage, such as counselling, and provide the available evidence. We review what needs to be explained in your petition.
MARRIED SOMEWHERE ELSE?
Your wedding did not have to take place in Jamaica.
You may have married and lived elsewhere. What matters for a Jamaican court is the required legal connection.
For divorce proceedings, at least one spouse must be a Jamaican national, domiciled in Jamaica, or resident in Jamaica when proceedings begin and ordinarily resident here for at least the preceding 12 months.
Tell us about each spouse’s nationality and where you live. Domicile is a legal question; we will review the connection rather than ask you to decide it yourself.
What to bring at the start.
We will guide you on sharing documents securely. Please do not upload certificates or your spouse’s photograph through the initial enquiry form.
Original marriage certificate
Bring your original marriage certificate, including where the marriage took place overseas.
Relevant children’s original birth certificates
Include children, in or outside the marriage, who need maintenance because they are minors or adults unable to care for themselves. Tell us their ages, schooling and dependency circumstances so we can advise on the relevant requirements.
A clear photograph of your spouse
This helps the process server identify the spouse being served and explain that identification in the affidavit of service.
Children’s care and maintenance arrangements matter.
Where there are children under 18—or up to 21 if in school—the court requires information about proper care and maintenance arrangements. Tell us about any child who remains dependent because of incapacity or inability to care for themselves.
Providing children’s documents does not mean the service covers a disputed custody or maintenance matter. We screen those issues separately.
From the petition to the final divorce order.
We prepare and file the petition in the Supreme Court, guide service and handle the applications through the decree stages.
- 01
Prepare and file
We review the facts and documents, prepare the petition and file it in the Supreme Court.
- 02
Serve your spouse
The petition must be served on the other spouse. If they live overseas, an application can be made for the court to permit service in another country.
- 03
Apply for Decree Nisi
This is the provisional decree stage. It does not mean the marriage has finally ended.
- 04
Apply for Decree Absolute
After the required period and once the necessary conditions are met, we apply for the final order dissolving the marriage.
TWO DIFFERENT STAGES
Decree Nisi is provisional.
Decree Absolute is the final order.
After Decree Nisi
The ordinary minimum period before the decree can be made absolute is six weeks. That is a stage within the process—not a promise that the whole divorce takes six weeks.
If you change your mind or reconcile before the final order, tell us promptly so we can advise on the appropriate steps. The marriage has not been dissolved merely because a Decree Nisi was granted.
Before planning another marriage
You need the Decree Absolute. Do not treat the petition or Decree Nisi as a final divorce, or set a new wedding date around an assumed completion date.
We explain the position as the matter progresses; the final order must actually be obtained.
A REALISTIC EXPECTATION
A straightforward matter
does not mean a quick divorce.
In KSA’s experience, most Jamaican divorces are not finalised in under a year.
The process can be protracted. Filing, service, the decree applications and court processing all take time. The six-week period after Decree Nisi is only one part of that journey.
We can explain the steps and keep you informed. We cannot promise a completion date to fit another wedding or personal deadline.

START WITH A SUITABILITY REVIEW
Is KSA’s non-contentious
divorce service right for you?
Tell us a little about your situation. We’ll guide you to the appropriate next step.
Client Care reviews your enquiry before it proceeds to the appropriate advice or consultation. We will explain the scope and fees before engagement.
An enquiry does not create an attorney-client relationship. Keep certificates, children’s personal information and your spouse’s photograph out of this initial form.
